Terms of Service
These Terms of Service (the “Terms”) are a binding agreement between you and FieldPOV, Inc. (“FieldPOV,” “we,” “us,” or “our”). They govern your application to FieldPOV, your use of our website, mobile app, and camera kit, and the footage you record and submit to us as an operator.
By applying, creating an account, accepting a kit, or submitting footage, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use FieldPOV.
1. Who can use FieldPOV
To be an operator you must be at least 18 years old, legally authorized to work in the United States, and located in a market we currently serve. FieldPOV is offered in the United States only.
You must record only work that you are lawfully performing and that you have the right to record. If your employer, a general contractor, a property owner, or a client controls the jobsite, it is your responsibility to have permission to wear the camera and capture footage there.
2. The nature of our relationship
FieldPOV is a platform that licenses first-person (“ego”) footage of skilled trade work. You participate as an independent contractor, not an employee, agent, partner, or joint venturer of FieldPOV. Nothing in these Terms creates an employment relationship.
Participation is voluntary and project-based. We do not guarantee any minimum amount of work, hours, footage acceptance, or earnings. You are free to record as much or as little as you choose, and you control when the camera is on.
As an independent contractor, you are responsible for the manner and means of your own trade work, for your own tools and safety, and for your own taxes. You are not covered by FieldPOV for workers' compensation, unemployment, or employee benefits.
3. Applying and your account
When you apply, you agree to provide accurate, current, and complete information, and to keep it up to date. You are responsible for the activity that occurs under your account and for keeping your login credentials secure.
Applying does not guarantee acceptance. We accept operators in limited cohorts and may prioritize, waitlist, or decline applicants at our discretion. We may ask for additional information or documentation to verify eligibility.
4. The camera kit
If you are accepted, we ship you a camera kit at no cost to you. Unless we tell you otherwise in writing, the kit remains the property of FieldPOV and is loaned to you for the purpose of recording and submitting footage.
- Use the kit only as intended and follow the setup and safety instructions we provide.
- Keep the kit in good working condition and take reasonable care to prevent loss, theft, or damage beyond normal wear.
- Do not sell, lend, modify, reverse engineer, or tamper with the kit or its software.
- Return the kit promptly if we request it or if your participation ends, using the method we provide.
You are responsible for ensuring it is safe and appropriate to wear the kit for a given task, and for removing it whenever wearing it could create a hazard.
5. Recording rules and operator conduct
You are the operator, never the subject. You control the camera, and you are responsible for what you choose to record. You agree to record responsibly and lawfully, and in particular you agree to the following.
- Record only your own trade work and jobsite, and only where you have the right to do so.
- Obtain any consent required by law or by the people and property owners around you before recording, and stop recording immediately when asked.
- Do not record people in places where they have a reasonable expectation of privacy (for example, inside homes beyond the work area, bathrooms, or changing areas).
- Do not deliberately capture children, medical or health information, financial information, passwords, license plates, documents, screens, or other sensitive personal information.
- Do not record at sites where recording is prohibited, including secured, classified, or restricted facilities.
- Audio is off by default; do not enable or add audio of other people without their consent.
- Do not record anything unlawful, harassing, discriminatory, dangerous, or that infringes someone else's rights.
Our kit is designed to blur personally identifiable information on your device before footage is uploaded, but that technology is an aid and not a guarantee. You remain responsible for following these rules.
6. Review, approval, and submission
Every clip lands in your app first. You can watch it, trim it, or delete it. Nothing is uploaded to FieldPOV until you approve and submit it. Deleting a clip you do not want to submit is always free and never reduces your pay for work you did submit.
Once you submit a clip, you are representing that it complies with these Terms. We may review, accept, reject, redact, blur, edit, or remove submitted footage at our discretion, including footage that does not meet quality standards or that may violate these Terms or the rights of others. You agree not to circumvent or interfere with our review and quality-control processes.
7. Rights in your footage
You keep ownership of the footage you record. By submitting footage to FieldPOV, you grant us a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-bearing license to host, store, reproduce, modify, create derivative works from, process, distribute, license, and otherwise use the submitted footage and any data derived from it, for any purpose, including training, developing, and evaluating artificial intelligence and robotics systems and licensing footage and derived datasets to our customers.
We may de-identify, transform, and combine your footage with other data. To the extent permitted by law, you waive any moral rights in the submitted footage. The license for footage you have submitted survives the end of your participation; deleting your account does not require us to recall footage already licensed to customers or already used to train models.
FieldPOV owns the platform, the app, the kit software, our trademarks, and all related intellectual property. These Terms do not grant you any rights in them except the limited right to use them to participate.
8. Payments and taxes
We pay operators for usable, approved footage. Unless we agree otherwise in writing, pay is calculated per qualifying hour of accepted footage and is paid weekly by direct deposit (typically each Friday) to the account you designate. Referral bonuses, where offered, are paid in addition and on the terms stated when they are offered.
- Only footage that is submitted, accepted, and meets our requirements is eligible for pay. Clips you delete before submitting, or that are rejected for failing our rules or quality standards, are not paid.
- You are responsible for providing accurate payment details. We are not liable for amounts misdirected because of details you provided.
- As an independent contractor, you are responsible for all taxes on your earnings. We may issue tax forms (such as a Form 1099) and collect tax information as required by law.
- We may withhold, adjust, or reverse payments that result from fraud, error, rights infringement, or a violation of these Terms.
9. Your warranties and indemnity
You represent and warrant that you have the right to record and submit each clip; that you have obtained any necessary permissions and consents; that your footage and conduct comply with these Terms and all applicable laws; and that your submissions do not infringe the privacy, publicity, intellectual property, or other rights of any person.
You agree to indemnify and hold harmless FieldPOV and its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your footage, your conduct as an operator, your breach of these Terms, or your violation of any law or third-party right.
10. Confidentiality
You may receive non-public information from FieldPOV, such as task instructions, quality criteria, pricing, and product details. You agree to keep that information confidential, to use it only to participate as an operator, and not to scrape, copy, or share platform materials except as needed to perform your work.
11. Safety and assumption of risk
You perform your trade work on your own and at your own risk. FieldPOV does not direct, supervise, inspect, or control your work, your jobsite, or your safety practices, and we are not responsible for them. You agree to follow all applicable safety laws and jobsite rules, to use appropriate protective equipment, and to stop wearing the kit whenever it could compromise your safety or anyone else's.
12. Suspension and termination
You may stop participating at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, create a safety or legal risk, submit low-integrity or infringing footage, or for any other reason at our discretion. On termination, you must stop using the platform and return the kit if we request it. Sections that by their nature should survive termination (including rights in footage, warranties, indemnity, disclaimers, and limitation of liability) will survive.
13. Disclaimers
The platform, app, and kit are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure. Your use of FieldPOV is at your own risk.
14. Limitation of liability
To the fullest extent permitted by law, FieldPOV will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or your use of FieldPOV. Our total liability for any claim relating to these Terms will not exceed the greater of the amounts we paid you in the three months before the event giving rise to the claim, or one hundred U.S. dollars (US$100).
15. Dispute resolution and arbitration
Please read this section carefully; it affects how disputes are resolved. You and FieldPOV agree to first try to resolve any dispute informally by contacting us at support@fieldpov.com and allowing 30 days to reach a resolution.
If we cannot resolve a dispute informally, you and FieldPOV agree that any dispute arising out of or relating to these Terms or FieldPOV will be resolved by binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court or seek injunctive relief for intellectual-property or unauthorized-use claims. You and FieldPOV waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as part of any class or representative proceeding.
You may opt out of this arbitration agreement by sending written notice to support@fieldpov.com within 30 days of first accepting these Terms. If any part of this section is found unenforceable, the remainder will continue to apply, and this section survives termination of your relationship with FieldPOV.
16. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration section. Where arbitration does not apply, disputes will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of FieldPOV after changes take effect means you accept the updated Terms.
18. Text messages
If you provide your phone number and opt in, we may send you text messages about your application, kit, payouts, and participation. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP, or reply HELP for help. Opting out of texts may limit our ability to reach you about time-sensitive matters.
